1. About these Terms

These Terms of Service ("Terms") govern your use of The Family Chart (the "Service"), ABN 49 262 782 826, based in Queensland, Australia ("The Family Chart", "we", "us", "our").

By creating an account, paying a subscription, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

These Terms are governed by the laws of Queensland, Australia. You and The Family Chart submit to the exclusive jurisdiction of the courts of Queensland for any dispute arising under these Terms, except where the Australian Consumer Law gives you a right to a different jurisdiction.

2. Who Can Use the Service

2.1 Account Holders Must Be Adults

You must be at least 18 years old and capable of entering into a legally binding contract. You represent that you have authority to create an account and bind yourself to these Terms.

2.2 Children's Data

The Service allows you to record information about children in your care (routines, schedules, fitness, care notes). You must have legal authority to collect and share such information, and you must comply with all applicable laws (including Australian Privacy Act and any state-based guardianship laws).

2.3 Linked Households & Co-Parents

If you link your account with another household (co-parent or carer), both parties must agree to these Terms and the applicable privacy permissions.

3. Acceptable Use

You agree not to:

• Use the Service for illegal purposes or in violation of any law
• Harass, abuse, or threaten other users
• Share false or misleading information about children in your care (except where consensually agreed by co-parents)
• Attempt to hack, reverse-engineer, or undermine security
• Remove or obscure any copyright, trademark, or proprietary notice

4. Subscription & Billing

4.1 Subscription Plans

The Service is offered under a paid subscription model with multiple tiers. Prices are listed in AUD including GST. All plans include a 7-day free trial.

4.2 Billing Cycle

Subscriptions renew automatically on a monthly or annual basis, depending on your chosen plan. You are responsible for ensuring your payment method remains valid.

4.3 Cancellation

You may cancel your subscription at any time via your Settings. Cancellation takes effect at the end of your current billing cycle. No refunds are issued for partial months or early cancellation.

5. Limitation of Liability

To the extent permitted by law, the Service is provided "as is" without warranties. We are not liable for indirect, incidental, or consequential damages, including loss of data or business interruption. Our total liability is limited to the amount you paid in the 12 months preceding the claim.

Nothing in this clause excludes or limits liability for death, personal injury, fraud, or breaches of fundamental terms that cannot be excluded under Australian Consumer Law.

6. Intellectual Property

You retain all rights to your family data. We retain all rights to the Service, including software, design, branding, and documentation. You grant us a license to use your data to provide the Service and improve it.

7. Suspension & Termination

We may suspend or terminate your account if you breach these Terms, engage in illegal activity, or pose a risk to other users or the Service. We will provide notice where practicable.

8. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service constitutes acceptance of the updated Terms. We will notify you of material changes.
